No

Does your claim involve content on GitHub or npm.js?

GitHub

Please describe the nature of your copyright ownership or authorization to act on the owner's behalf.

I am the copyright owner. I [private] the project.

Please provide a detailed description of the original copyrighted work that has allegedly been infringed. If possible, include a URL to where it is posted online.

I recently had to submit a takedown request for [invalid] and it was accepted, but when I was looking through the owners repository list to make sure there's nothing else I found that he has a backup located at https://github.com/nenge123/eumjs . It looks to just be a backup to the other repository.

Original works: https://github.com/ethanaobrien/emulatorjs
Infringed content: https://github.com/nenge123/eumjs

I opened an issue here ([invalid]) asking them to state changes and he said "no". He claims to have downloaded the code from here (http://www.emulatorjs.com/emulator.js) but when looking at his code there are several features that I implemented that are not in the emulator.js file the claims to have downloaded. For example, localization and screen recording. He has also been opening several problems within my repository showing that he does still depend on the code.

He claims that it is not from my licence because I divided the main javascript file, while he still has it in 1 file.

He has modified versions of the core emulator files. (https://github.com/nenge123/eumjs/tree/master/cores7z)

Looking though his code, he obviously uses an older version of my repository, but seems to watch the changes I make. One change I made recently fixed some mobile problems.

He obviously has copied the code, but claims to not have ever used code from my repository.

What files should be taken down? Please provide URLs for each file, or if the entire repository, the repositorys URL.

No

Have you searched for any forks of the allegedly infringing files or repositories? Each fork is a distinct repository and must be identified separately if you believe it is infringing and wish to have it taken down.

The repository has no forks

Is the work licensed under an open source license?

Yes

Which license?

Apache License 2.0

How do you believe the license is being violated?

The owner has not stated the changes from my repository. I have asked him to state changes and he said no

What changes can be made to bring the project into compliance with the license? For example, adding attribution, adding a license, making the repository private.

They would need to either state the licence and changes or make the repository private

What would be the best solution for the alleged infringement?

Reported content must be removed

Do you have the alleged infringers contact information? If so, please provide it.

I have taken fair use into consideration.

I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

I have read and understand GitHub's Guide to Submitting a DMCA Takedown Notice.
