While it's certainly not GitHub's fault that the files were hosted illegally (nor what I ever imply that it is), may I ask for a feature request? If it's possible in the future, could file hashes of DMCA content be indexed and then use to lookup against new files submitted to GitHub?

I imagine that might be a computational impossibility but it's just a suggestion.

Is the work licensed under an open source license? If so, which open source license? Are the allegedly infringing files being used under the open source license, or are they in violation of the license?

What would be the best solution for the alleged infringement? Are there specific changes the other person can make other than removal?

The best solution would be to remove the copyrighted material.
